1.1 By instructing COMPASS INVESTIGATIONS UK Ltd (trading as Compass Investigations), to proceed with a case on your behalf, you are entering a contract between the ‘you’ (referring to the client of Compass Investigations in its pre agreed capacity, be it individual or companies) and ‘us’ ‘we’ ‘our’ (being Compass Investigations and its employee’s in any capacity)
2.1 COMPASS INVESTIGATIONS UK Ltd shall provide the following services (“services”) to the Client in accordance with the terms and conditions of this Agreement. Services include, but are not limited to Surveillance, Counter Surveillance (TSCM), Matrimonial & Family Investigations, Tracing, Technical & Hidden Device Installation, Missing person/s location, vehicle tracking, Employee Investigations, Physical Penetration “Pen” Testing & Process Serving.
2.2 Start date: COMPASS INVESTIGATIONS UK Ltd shall commence the services at a time agreed by both client and investigator and on written or verbal instruction from the client.
2.3 Completion date: COMPASS INVESTIGATIONS UK Ltd shall complete/cease to provide the agreed services either at the achievement of objective or at a time when the investigator concludes appropriate.
2.4 COMPASS INVESTIGATIONS UK Ltd will endeavour to provide all its services in the most cost effective and time efficient manner possible. However, the paid services are investigation and not the desired outcome. Factors and constraints out of our control may render an investigation futile or provide us with insufficient results. Under these circumstances COMPASS INVESTIGATIONS UK Ltd will advise you of this as soon as it is operationally possible. If this occurs, the client is still bound by the terms and as such, our agreed fee is still payable.
3.1 COMPASS INVESTIGATIONS UK Ltd will ask for your personal details from you, the Client, to include name and place of residence and a photographic ID. These will remain confidential and any information will be stored in accordance with GDPR regulations.
3.2 COMPASS INVESTIGATIONS UK Ltd will furthermore ask you to provide personal information on progression on the investigation. As a bare minimum, on entering this agreement the client is to provide us with, but not limited to; a name for the subject of investigation, date of birth and age, travel details, current living or work address if known and photographs for identification.
3.3 As we use the data supplied by the client when conducting all investigations, should the client provide false or wholly inaccurate data from the outset or withhold critical information, we will not be held responsible for the content of any reports provided by us. It is the client’s responsibility to provide accurate information concerning the subject of any investigation.
4.2 In no event, shall COMPASS INVESTIGATIONS UK Ltd be liable for any damages sustained by you, the client.
4.3 No clauses will serve to limit or exclude either party’s liability for death or personal injury arising from its own negligence.
5.1 You, the Client, agree to pay all fees and charges (and applicable costs incurred post investigation if any) as agreed by both parties prior to commencement of investigations in accordance with the Terms & Conditions.
5.2 If entered into agreement as a PRIVATE CLIENT, you will make payment to us in full and before any services are rendered unless in extreme circumstances for example, where time constraints apply.
5.3 If entered into agreement as a CORPORATE CLIENT you will be invoiced before or after services are rendered and invoices will be paid within 14 days of being sent.
5.4 We will accept payment of services by credit card, debit card, direct debit, BACS and electronic transfer, but we reserve the right to refuse any payment method if we have reasonable cause to believe such payment may be dishonoured. We are unable to receive payment via cheque. COMPASS INVESTIGATIONS UK Ltd do not accept any responsibility for failed payments of any type.
5.5 Some fees may be payable in full, in advance for specific services. We will notify you of this upon acceptance of your instructions.
5.6 In default of payment of an invoice, COMPASS INVESTIGATIONS UK Ltd may in its absolute discretion and irrespective of any other rights maintain an action against the client for the invoice sum upon which interest shall be payable at the rate of 2% per calendar month or part thereof from the date of the invoice until payment.
5.7 Any further costs incurred by COMPASS INVESTIGATIONS UK Ltd in pursuit of the overdue fee will also be charged.
6.1. These terms shall be effective on the date hereof and shall continue, until the Completion Date. A Cancellation request from you, the client, will need to be in writing and accepted by us no later than 48 hours prior to when services are scheduled to begin. A full refund will be issued if a case is cancelled no later than 48 hours before an investigation (in any capacity) is due to commence. This is non-negotiable.
6.2 If an investigation is cancelled within 48 hours of an investigation starting COMPASS INVESTIGATIONS UK Ltd reserve the right to not issue a full refund.
6.3 COMPASS INVESTIGATIONS UK Ltd reserve the right to cancel an investigation at any time and without warning but circumstances must be severe to not issue a full refund.
6.4 If at any point during services being rendered by us and any member of our staff become in danger or asked to be placed in a situation where risk is greater than reward, we reserve the right to cancel the investigation without issuing a refund.
6.5 If a client withholds relevant case detail or information when instructing us, which later becomes available, COMPASS INVESTIGATIONS UK Ltd reserve the right to cancel any and all agreement/s. Furthermore, any payments made will not be refunded.
7.1 COMPASS INVESTIGATIONS UK Ltd will treat all information passed to us as confidential and will not be passed to any third party unless instructed by you, requested by an authority possessing the correct legal documentation or requested by a court of law.
7.2 All information kept with regards to an investigation will be held in accordance with UK Data Protection Laws.
8.1 Communication between the client and COMPASS INVESTIGATIONS UK Ltd will be within the terms agreed as set out from the first enquiry. For security reasons during an investigation please make us aware of any immediate issues or changes in regard to forms of communications.
9.1 The client agrees that the client is solely responsible for fully complying with any laws, taxes or tariffs applied in any way to services rendered by us.
9.2 The Client will hold harmless and defend and COMPASS INVESTIGATIONS UK Ltd, its staff, sub-contractors and agents from any claim, suit, penalty, tax, fine, or tariff or any failure to comply with any such laws, taxes and tariffs, whilst operating on behalf of the client.
9.3 In no event will COMPASS INVESTIGATIONS UK Ltd be liable to the Client or any third party for any damages including, but not limited to: service interruptions caused by Acts of God, power failures or any other circumstances beyond our reasonable control, any lost profits, lost savings or other incidental, consequential, punitive, or special damages arising out of the operation.
10.1 Whilst COMPASS INVESTIGATIONS UK Ltd aims to provide the best service possible, In the unfortunate event of a client grievance, this must first be advised by email or writing. All complaints must be made writing to our office address or by email to info@compass-investigations.co.uk and must be accompanied by supporting evidence. All complaints will be acknowledged within 24 hours and we aim to resolve within 7 days to a degree accepted by both parties. Any client posting to social media or review sites before we have concluded our enquiries, will forfeit their right to a refund, retrace or otherwise.
